By accessing or using Spear AI ("Spear", "we", "us", or "our") at spearai.live, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.
2. Description of Service
Spear is an AI-powered real-time sales coaching platform designed for life insurance agents. Spear listens to call audio through your device microphone, analyzes conversations, and provides in-call coaching suggestions. Spear provides coaching on sales process only. All product recommendations are the agent's independent professional judgment. Prospects are informed of recording per applicable state law.
3. Eligibility
You must be at least 18 years old and a licensed insurance professional or authorized representative to use Spear. By using Spear, you represent that you meet these requirements.
4. Subscriptions and Billing
Spear offers monthly subscription plans. You authorize us to charge your payment method on a recurring monthly basis. All fees are non-refundable unless otherwise required by law. You may cancel your subscription at any time and retain access through the end of your billing period.
5. Call Recording and Compliance
You are solely responsible for complying with all applicable federal, state, and local laws regarding call recording, including obtaining any required consent from call participants. Spear does not assume responsibility for your compliance with recording consent laws. You agree to inform prospects that calls may be recorded or monitored before using Spear on any call.
6. Acceptable Use
You agree not to use Spear to engage in fraudulent, deceptive, or illegal activity; misrepresent insurance products to prospects; violate any applicable insurance regulations; or reverse engineer, copy, or redistribute the Spear platform or its underlying technology.
7. Intellectual Property
All content, features, and technology on Spear are the exclusive property of Spear Sales AI LLC. You may not copy, modify, distribute, or create derivative works without prior written consent.
8. Disclaimer of Warranties
Spear is provided "as is" without warranties of any kind. We do not guarantee that the platform will increase your close rate, generate specific results, or be uninterrupted or error-free. Coaching suggestions are AI-generated and do not constitute professional legal, financial, or insurance advice.
9. Limitation of Liability
To the maximum extent permitted by law, Spear Sales AI LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including lost revenue, lost customers, or regulatory penalties.
10. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any conduct we determine to be harmful to other users or to Spear.
11. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
